If puppy is sold without breeding rights, or without being on a co-own contract, the puppy must be spayed or neutered before the age of 9 months.  Proof of spay or neuter must be sent to “Seller” in
order for “Buyer” to receive registration papers.

The "Seller" will provide up to date health record information to "Buyer" at time of transfer of puppy verifying all vaccinations and de-worming up to date for appropriate age.

"Seller" guarantee's puppy to be free of diseases at time of transfer of said puppy to "Buyer" for a period of (3) days. "Seller" is not held responsible for stress related outbreaks (including diarrhea)
caused by transfer of said puppy to a new environment.  "Seller" will make themselves available to "Buyer" for questions, concerns, and to assist with advice on how to maintain a smooth and as
stress free as possible transition.

"Buyer" agrees to have said puppy examined by a licensed small animal veterinarian within (3) days of receipt of said puppy.  By signing this contract, "Buyer" waves the health guarantee if not
examined during this three-day period.  If said puppy is found to be in poor health during this time period, as evidenced by a signed, written report by a licensed veterinarian, buyer will have the option to
return the puppy at "Buyer’s" expense for a full refund or replacement as soon as comparable (of equal value) becomes available. "Seller" has the right to request a second opinion from a non-
associated veterinarian within a reasonable distance of "Buyers" home. To refund or replace will be the choice of the "Buyer". If "Buyer" decides to keep said puppy, no refund will be provided & they
will assume all expenses involved with said puppies care.

"Seller" will replace (of equal value) or refund with proper verification for
genetic defects resulting in debilitating conditions that will take the puppy’s life, due to genetic health problems, discovered within 24 months from birth of said dog/puppy.  At that time "Buyer" can either
keep said dog/puppy and assume all medical expenses with a refund of half of purchase price from "Seller" or return said dog/puppy at "Buyers" expense for a replacement puppy of equal value.  
"Seller" has the right to, at any time, decide to stop breeding Toy/Miniature Australian Shepherds.   In this case, if a replacement puppy cannot be given, then the purchase price of said dog/puppy will
be refunded to the "Buyer".  And money paid for shipping will not be refunded.  Due to Breeder only breeding limited number of litters per year, Breeder has up to 12 months to supply a replacement
puppy, otherwise a refund will be given.

"Seller" makes no guarantees regarding accidental death, theft, and/or sickness due to lack of vaccinations, lack of de-worming or lack of proper care.

"Buyer" certifies, by signing this agreement, that said puppy/dog will live with the "Buyer".
"Buyer" certifies, by signing this agreement, that said puppy/dog will have adequate exercise, shelter, nutritious food, fresh water, and all necessary health care from a licensed veterinarian.
"Buyer" certifies, by signing this agreement, that said puppy/dog will be given all necessary vaccinations and de-worming necessary to keep said puppy/dog healthy and safe from disease.
"Buyer" certifies, by signing this agreement, that he/she is not acting as an agent in this purchase.
"Buyer" certifies, by signing this agreement, that he/she will not sell or give said puppy/dog to a pet store, pound, animal shelter, guard dog business, or research facility.
"Buyer" certifies, by signing this agreement, that he/she will not euthanize said puppy/dog for any reason other than health or sickness without first notifying the breeder and giving the breeder the chance
to find alternative care for the said puppy/dog.
"Buyer" certifies, by signing this agreement, that he/she will not leave said dog/puppy to be chained/tied outside alone.  If dog/puppy ever needs to be chained/tied outside, then the dog/puppy must be
adequately supervised by “Buyer” outside
at all times.

"Buyer" certifies, by signing this agreement, that if ever he/she no longer wants, or can no longer take care of  the puppy/dog at any time in said puppy/dogs life, he/she will give “Seller” first opportunity
to find said puppy/dog a suitable home at no cost to “Seller.”  Further more, at any time in said dog/puppy’s life the “buyer” can no longer care for or no longer wants the dog/puppy, the “Seller” will take
back the dog at no cost to “Seller.”  Any transfer of ownership is considered breach of this contract unless otherwise authorized by “Seller.”   Under no circumstances whatsoever is said puppy/dog to
end up in a shelter or a pound.  

"Buyer" certifies, by signing this agreement, that he/she will attend one Puppy Play or Socialization Class between the ages of 9 and 18 weeks old, AND, at least one obedience/training class before 6
months old.

"Seller" reserves the right to refuse the sale of one of the “Seller’s” dogs to anyone.

"Buyer" has the option to pick up their puppy from the “Seller’s” home, or to have said puppy shipped by air. All airline charges are the expense of the "Buyer".  Proper health clearances and any other
paperwork are the responsibility of the Buyer.  In event of international shipping, if the pup is refused entry to your country, and sent back to “Seller.”  All costs incurred are the responsibility of the
Buyer.  And, puppy may not be re-shipped, and, this contract and sale may become null and void.   This is for the protection of the puppy.  In the case of a puppy being refused at the border & returned
to “Seller,” a refund of the purchase price of the puppy will be given.  

If "Buyer" chooses to have said puppy shipped, "Seller" will research all airlines for most economical flight. "Seller" will always give first preference to the comfort and safety of said puppy as a priority.
"Seller" will make all flight arrangements keeping in mind "Buyers" time zone and convenience whenever possible. "Seller" will supply selected airlines with a official veterinary health certificate. "Seller"
will supply a safe, airline approved shipping crate. “Buyer” is responsible for cost of the crate.  "Seller" will deliver said puppy to the airport with all necessary documentation, as well as a small supply of
what the puppy is currently eating.  "Seller" will notify "Buyer" by phone as soon as said puppy has been officially signed over to the designated airport. "Buyer" will immediately upon receipt of said
puppy/dog call "Seller" to notify "Seller" that "Buyer" has taken possession of said puppy.

"Seller" does not guarantee a puppy to stay within size standard. (i.e., a Toy with a size limit of 14" could mature over 14" then classifying it as a Mini).

A $200.00 deposit is required to reserve a puppy. Once you have made this deposit, it is non-refundable with the exception of further information in this paragraph.  The "Buyer" understands that there
may be 2(two) reserves on one puppy. One reserve is if the puppy is evaluated as a pet, a separate reserve is if the puppy is evaluated as a show/breeding puppy at said puppy’s evaluation,
performed between 7.5 – 8.5 weeks of age. If said puppy evaluates differently than you have reserved, (reserved show/breeding and evaluates pet, or reserved pet and evaluates show/breeding) it will
be the decision of the "Buyer" to choose to get a full refund from the "Seller" for the reserve deposit, or wait for the next litter and keep the reserve on file.

The said puppy may be paid in full for by the following:
1.       By cheque. This must be paid at least 10 days prior to transfer of said puppy to clear bank.

2.       By account to account wire transfer. This must be done at least 7 days prior to transfer of said puppy/dog. All fee's associated with transfer are those of the "Buyer.”

3.       By credit card/debit card using Pay Pal. "Buyer" will be charged a 3.5% processing fee charged by Pay Pal.

4.        By cash. (The preferred method)

5.        By email funds transfer.  “Buyer” will email “Seller” a password to accept the funds transfer. (the second best preferred option)


"Buyer" agrees that this contract is non-transferable.
"Buyer" has read and understands the foregoing and agrees that all parts of this contract are a binding agreement with the "Seller". If either the "Buyer" or "Seller" takes legal action regarding this
contract, action will be initiated in the county of the "Seller's" residence. Legal fees and court costs shall be the responsibility of the party found at fault.

(For a Male dog)

As well as the above (or attached pet contract), the Buyer agrees to the following:

1.        Dog must remain unaltered until Breeder makes the decision to alter dog. After the agreed amount of breeding, or the agreed amount of years the dog must remain intact and available for stud
use, the Breeder may request that the Buyer have the dog altered.  Cost of altering is the responsibility of the Buyer.  Buyer must provide proof of neuter to the Breeder in order to obtain transfer of
registered ownership papers.   If Buyer refuses to alter the dog within 3 months of the Breeders request, Breeder has the right to take back the dog and have it altered herself.  Dog will be returned upon
payment of cost to neuter.
2.        Dog must be kept in good health, and groomed on a regular basis.  Minimal grooming consists of brushing the coat to keep it free from tangles & matts, and keeping nails trimmed.
3.        Dog must not be allowed to breed to any dog other than each dog(bitch) the Breeder has chosen.  Dog must be properly confined as to not allow it to reproduce.  A fenced back yard is
preferred.  You may not offer the dog to anyone else to use as a stud.
4.        Dog must be available to Breeder for breeding purposes.  Advance notice will be provided.  Dog will stay with Breeder or owner of dog(bitch) to be bred, for a minimum of 1 day to a maximum of
12 days for each breeding.
5.        Dog stays in Breeders name as the registered owner of the dog until the Co-Own part of this contract is fulfilled.  This contract is fulfilled when dog has been neutered.  Breeder will then transfer
ownership of the dog to Buyer and send Buyer the registration papers.
6.        Before the dog is 2 years old, it will have his eyes and hips tested to be sure he is suitable for breeding purposes.  Breeder will cover this cost.  Also, any other test required in order for this dog
to be used as a stud dog, will be the responsibility of the Breeder.  All other Vet costs including regular or emergency examinations, vaccinations, and medications are the responsibility of the Buyer for
the life of the dog.
7.        This dog is your pet/companion.  He will live with you and be your dog for his lifetime.  All costs of food, training, grooming, toys, boarding fees, etc., are the responsibility of the Buyer.
8.        Buyer agrees to have dog shown in conformation shows until he receives the title of Champion.  If Buyer does not want to show the dog themselves, Breeder will be happy to show the dog for
them.  Show entry fees will be responsibility of the Breeder, unless Buyer wishes to show the dog themselves.  Note:  The more Best of Breed, or Champion wins a dog receives, the more attractive
he will be to other breeders, and therefore, more breeders will want to use him as a stud.
9.        No stud fee will be paid to Buyer for studding to one of Breeders dogs. (Follow Me Aussies dogs or co-owned dogs.)  
10.       A stud fee will be paid to the Buyer from the Breeder in the maximum amount of ____% of the stud fee Breeder receives from an outside Breeder of the dog (bitch) to be bred, approximately
$____.__.  Stud dog fee to be reduced if less than 4 pups are produced from the resulting litter.  For example, if only three live pups are born, the stud fee will be reduced by 25%.  This payment to be
paid to Buyer after litter is born and before the puppies turn 10 weeks old.
11.        If dog sires a litter with one of my (the Breeder's) dogs or co-own dogs, Buyer will be given priority over other pet buyers for a second dog.  Especially if Buyer agrees to another co-own
agreement with that dog.
12.        Buyer agrees to either provide photos of dog (preferably “stacked”) at regular intervals until this contract is fulfilled, one photo between 3 & 4 months of age, one at one year of age, and one at 2
years of age, or allow Buyer access to dog at these regular intervals for photographing the dog.
